1. Agreement to Terms
By accessing or using PxlPeak's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
PxlPeak provides AI implementation and digital services including but not limited to AI chatbot development, AI voice agents, workflow automation, AI integration, AI content production, AI strategy consulting, web design, and SEO. The specific services, deliverables, and timelines will be outlined in individual service agreements.
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information necessary for services
- Respond to communications in a timely manner
- Grant necessary access to accounts and platforms
- Review and approve deliverables within agreed timeframes
- Make payments according to agreed terms
4. Intellectual Property
Upon full payment, clients own all custom work created specifically for them, including website designs, content, and creative assets. PxlPeak retains ownership of proprietary tools, methodologies, and pre-existing materials. We reserve the right to showcase completed work in our portfolio unless otherwise agreed.
5. Payment Terms
Payment terms are specified in individual service agreements. Late payments may result in service suspension or termination. All fees are non-refundable unless otherwise stated in the service agreement.
6. Confidentiality
Both parties agree to maintain confidentiality of proprietary information shared during the course of the engagement. This includes business strategies, customer data, financial information, and any other sensitive materials.
7. Limitation of Liability
PxlPeak shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amounts paid by you for the services in question.
8. No Guarantees
While we strive for excellence, we cannot guarantee specific results such as response accuracy, automation rates, or revenue increases. AI implementation results depend on many factors beyond our control, including data quality, market conditions, and platform changes.
9. Termination
Either party may terminate the service agreement with 30 days written notice. Upon termination, the client will receive all completed deliverables and access to accounts and assets. Any outstanding payments become due immediately upon termination.
10. Website Use
When using our website, you agree not to:
- Use the site for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Transmit viruses or malicious code
- Scrape or collect data without permission
- Interfere with the proper functioning of the site
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the updated terms on this page. Continued use of our services after changes constitutes acceptance of the new terms.
